The Extent of The Influence of The Jurisprudent of Thought on The Malay Translations of Al-Qur’an. E-Jurnal

This research aims to explain the different aspects of the Malay translators in translating
the jurisprudence verses in three books of translation of the Qur’ān in the chosen Malay
language; Tafsir Pimpinan ar-Rahman by Syeikh Abdullah Basmeih, The Qur’an and
The Translation of It’s Meanings into the Indonesian Language, and The Tafsir of
Mahmud Yunos. These three Malay translations are among the most widely studied in
local mosques and being used in the Malay Archipelago, especially in Malaysia.
Describing the Malay Archipelago people, most of whom believe in the doctrine of
Shafi’i school in jurisprudent issues, the researchers may see that there are some
exceptions and differences in jurisprudential issues that the local community disagreed
with by the sayings of the Shafi’i school because of the jurisprudence of the fatwa
institutions. These differences are inferred from the opinions of fatwa institution,
according to the society’s customs and the contemporary circumstances, which do not
fit with Shafi’i school of thought’s opinions such as the ruling on the sale of the deposit
(Bay’ al-‘Urbūn), and the sale of al-Istiṣnā’. In this research, the method of descriptive
and inductive is being used to reveal the data discovered from the translations of the
selected verses. The research revealed that the specific jurisprudent affects the
translation of jurisprudential verses among the commentators due to their accurate
understanding of their specific jurisprudent school instead of other opinions from other
different schools of thought that the translators do not practice with.
